Terms & Conditions

1. About These Terms

These Terms and Conditions govern all services provided by Chun Christopher Tong trading as Vibe Party Co. (ABN: 12 153 397 560), referred to throughout as "Vibe Party Co.", "we", "us", or "our". By making a booking or engaging our services, you (the "Client") agree to be bound by these terms in full.
 

These terms apply to all services offered by Vibe Party Co., including but not limited to: Photo Booth Hire, Video Guestbook Hire, Party Hire (including Light Up Numbers, Plinths, Neon Lights, and Beer Pong Tables), Professional Photography, Videography, and Mobile Content Creation.

2. Bookings & Reservations

A booking is only confirmed upon receipt of both a signed Service Agreement and a 50% non-refundable deposit. We do not hold event dates without both being received in full. Bookings are taken on a first-come, first-served basis. Submitting an enquiry does not constitute a confirmed booking.

3. Deposits & Payments

  • A 50% deposit is required to secure your booking.

  • The remaining balance (final payment) is due no later than 14 days before your event date, unless otherwise agreed in writing.

  • All prices are in Australian Dollars (AUD).

  • Accepted payment methods will be confirmed at the time of booking.

  • Late payments may result in cancellation of the booking at Vibe Party Co.'s discretion.

4. Cancellations

In the event of cancellation by the Client:

  • Cancellations made 90 or more days before the event: the deposit is refundable in full.

  • Cancellations made within 90 days of the event: the deposit is non-refundable.

  • In either case, the deposit may be applied as a credit toward a new booking within 12 months of the original event date, subject to availability.

  • If a new booking is of lesser value than the original, any remaining credit is forfeited.

5. Postponements

The Client must notify Vibe Party Co. of any postponement at least 14 days prior to the original event date. If we are available on the new date, the original agreement and deposit will transfer at no additional cost, subject to any material or preparation costs already incurred. If we are unavailable on the new date, a credit for the paid amount will be issued, valid for 12 months from the original event date.

6. Overtime & Late Coverage

All services conclude at 12:00AM midnight unless otherwise agreed. Coverage beyond midnight attracts a $250 late accommodation fee, invoiced separately and payable within 14 days of the event.

Overtime fees of $120 per hour apply if the Client requests additional operating time beyond the booked duration. An invoice will be issued and must be paid within 14 days of the event date.

7. Final Consultation

For all bookings, a final consultation will be scheduled no later than 14 days before the event. This allows us to confirm setup requirements, venue access, event schedule, and any special requests.

8. Access & Venue Requirements

The Client is responsible for ensuring safe, clear, and direct access to the venue for setup and pack-down. For venues not on ground level, lift access must be provided. Where no lift is available, a flat $100 AUD labour fee applies for manual equipment handling via stairs. The Client may also arrange for on-site assistance, confirmed with Vibe Party Co. in advance.

 

Vibe Party Co. reserves the right to decline, delay, or modify service if access conditions are unsafe. Any delays caused by restricted access will not extend the booked service duration.

9. Setup Location & Weather

We strongly recommend indoor setup for photo booth services. Outdoor setups are permitted but the Client acknowledges risks including heat, cold, wind, rain, uneven surfaces, and variable lighting. In extreme weather, we reserve the right to request relocation to a safe sheltered area. We are not liable for reduced performance or inability to operate due to environmental conditions outside our control.

10. Permits & Parking

The Client is responsible for securing any required permits, council approvals, or permissions for the event venue. If paid parking is required, the Client agrees to cover parking costs for the full duration of service, including setup and pack-down. Any parking costs incurred will be added to the final invoice.

11. Equipment Liability — Hire Items

The Client accepts full responsibility for any loss, theft, or damage to Vibe Party Co. equipment caused by guests, venue staff, or environmental conditions, including but not limited to: the booth, printer, camera, backdrops, props, lighting, light up numbers, plinths, neon lights, and beer pong tables.

No food or beverages are permitted within the photo booth area. The Client agrees to inform guests of this and to monitor the area during the hire period.

In the event of a spill, stain, or damage to any item, Vibe Party Co. will assess and notify the Client before departing the event. Replacement or repair costs will be invoiced and payable within 14 days. If damage is not identified before departure, Vibe Party Co. accepts responsibility and will not pursue claims against the Client.

12. House Rules & Venue Compliance

Vibe Party Co. must comply with all venue rules and restrictions, including equipment placement, power usage, noise levels, load-in/out procedures, and operating hours. If venue rules limit or prevent our operation, we are not responsible for reduced service or missed usage time. Any negotiations with the venue are the sole responsibility of the Client.

13. Cooperation & Conduct

The Client and their guests are expected to cooperate with Vibe Party Co. attendants and follow reasonable instructions. We will not be held responsible for missed photo opportunities or service interruptions caused by lack of cooperation, obstruction, or interference from guests or venue staff.

14. Meals for Attendants

For events of 3 hours or more, the Client agrees to provide a meal and water for on-site attendants. This ensures continuous coverage without interruption. Meals should be provided around the same time as guests are served.

15. Lighting & Flash

Our photo booth uses flash or power spotlights. External lighting sources (DJ strobes, venue lighting effects, guest phone flashes) may occasionally interfere with image quality. We are not responsible for distortion, glare, or missed moments caused by lighting conditions outside our control.

16. Post-Production & Gallery Delivery

All digital files will be lightly edited for colour, exposure, and clarity. Only the best images are included in the final gallery. Test shots, duplicates, and unflattering images (e.g. eyes closed) may be removed at our sole discretion.

The digital gallery is password protected and delivered within 24 to 48 hours of the event unless otherwise stated. The gallery remains accessible for 30 days, after which it expires. Clients and guests are encouraged to download images promptly.

For Professional Photography, Videography and mobile content creation services, delivery timeframes will be confirmed in the individual service agreement.

17. Content Usage & Social Media

The Client's content usage preference is confirmed via the booking form. Subject to that selection, the Client authorises Vibe Party Co. to use event photos, videos, or content for promotional purposes only.

  • No content featuring individuals under the age of 18 will be shared publicly without explicit written permission from the Client.

  • If the Client selects "No" or notifies us in writing, no content from the event will be shared publicly.

  • Where "Yes – no faces shown" is selected, we will ensure shared content does not clearly identify individuals.

  • All privacy requests will be respected and honoured promptly.

18. Liability & Force Majeure

If Vibe Party Co. is unable to provide services due to illness, injury, emergency, or circumstances beyond our control, we will make all reasonable efforts to arrange a suitable replacement. If no replacement is available, our liability is limited to a full refund of payments made.

In the event of equipment failure or digital file loss beyond our control (including corrupted memory cards, power outages, or hardware malfunction), liability is limited to a refund of the booking amount. No further compensation will be provided.

19. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
